1. INTRODUCTION

This Privacy Policy (“Policy”) governs the collection, use, processing, storage, disclosure, and retention of information by E-Tracking Solutions (“Company”, “we”, “us”, “our”) in connection with the operation of its website https://etracking.pk, mobile applications, vehicle tracking devices, software platforms, reseller programs, and related services (collectively, the “Service”).

This Policy forms an integral part of the Company’s Terms & Conditions and any applicable reseller or service agreements.

By accessing, registering, purchasing, installing, or using the Service in any manner, you acknowledge that you have read, understood, and irrevocably agreed to be bound by this Policy.


2. APPLICABILITY

This Policy applies to:

  • customers and vehicle owners;

  • users of the Company’s mobile applications;

  • resellers, affiliates, and referral partners;

  • website visitors;

  • any individual communicating with the Company through electronic means, including WhatsApp, SMS, email, or telephone.


3. CATEGORIES OF INFORMATION COLLECTED

3.1 Personal and Identifying Information

The Company may collect personal information including, without limitation:

  • full name;

  • CNIC (where required by law);

  • email address;

  • telephone number;

  • residential or business address.

3.2 Vehicle and Service-Related Information

  • vehicle registration number, make, model, and type;

  • device IMEI, SIM information, and system identifiers;

  • installation location and service visit details;

  • subscription, activation, suspension, and service status.

3.3 Technical and Usage Information

  • IP address and access timestamps;

  • browser type, device type, operating system;

  • login records, system logs, and diagnostic data;

  • cookies and analytical data.

3.4 Mobile Application Data

  • application usage and interaction data;

  • device tokens used for push notifications;

  • permissions granted by the user within the application.

3.5 Reseller and Affiliate Information

  • identity and contact details;

  • commission calculations, performance records, and transaction history;

  • WhatsApp communications, confirmations, screenshots;

  • IP logs, timestamps, and electronic acceptance records.

3.6 Financial and Transactional Information

  • invoices, billing records, and transaction references.

The Company does not store debit card, credit card, or banking credentials. All payment processing is handled by third-party service providers.


4. COOKIES AND TRACKING TECHNOLOGIES

The Company uses cookies, tags, scripts, and similar technologies for operational, security, analytical, and performance purposes.

You may restrict cookies through browser settings; however, doing so may limit functionality of the Service.


5. PURPOSE AND LEGAL BASIS OF PROCESSING

Information is collected and processed for the following purposes:

  • delivery, installation, and technical support;

  • operation of tracking dashboards and mobile applications;

  • transmission of alerts via SMS, voice calls, and push notifications;

  • subscription management, billing, and account administration;

  • administration of reseller and referral programs;

  • calculation and verification of commissions and bonuses;

  • prevention of fraud, misuse, and unauthorized access;

  • compliance with applicable laws, regulations, and lawful requests;

  • protection and enforcement of the Company’s legal rights, assets, and reputation.


6. MOBILE APPLICATIONS AND PLATFORM DEPENDENCY

The Company’s mobile applications are distributed through the Google Play Store and Apple App Store.

The Company does not control and shall not be liable for:

  • platform availability or outages;

  • operating system restrictions or updates;

  • app suspension or removal decisions by platform operators.


7. ALERTS, PUSH NOTIFICATIONS, AND TELECOM DEPENDENCY

  • SMS and voice call alerts are transmitted through third-party telecom operators.

  • Push notifications are delivered using Firebase Cloud Messaging (FCM) and Apple Push Notification Service (APNs).

The Company does not guarantee delivery, timing, accuracy, or continuity of alerts, which depend on external networks, infrastructure, and device configurations beyond Company control.


8. ELECTRONIC RECORDS AND EVIDENCE

The Company may record, store, and rely upon:

  • IP addresses and timestamps;

  • system and access logs;

  • WhatsApp communications, screenshots, and message records.

Such records shall constitute valid, binding, and admissible evidence of consent, acceptance, communications, and transactions.


9. REGULATORY AND LEGAL COMPLIANCE

The Company operates in accordance with the laws of the Islamic Republic of Pakistan.

The Company does not operate or control telecom networks, GSM services, satellite systems, or internet infrastructure.

Information may be disclosed to courts, law-enforcement agencies, or regulatory authorities only where required by applicable law or lawful order.


10. LAWFUL USE OF TRACKING SERVICES

The Service is provided strictly for lawful vehicle monitoring purposes.

Any use for surveillance, stalking, harassment, or violation of privacy or law is strictly prohibited.
The Company bears no responsibility for misuse by customers, resellers, or third parties and reserves the right to suspend or terminate services upon detection of misuse.


11. DATA SHARING AND DISCLOSURE

Information may be shared with:

  • authorized installation and service personnel;

  • payment processors and financial partners;

  • telecom, SMS, and notification service providers;

  • hosting, analytics, and IT service providers;

  • government or regulatory authorities where legally required.


12. DATA RETENTION

Information is retained for:

  • the duration of the customer or reseller relationship; and

  • such additional period as required for legal, tax, audit, dispute-resolution, and enforcement purposes.


13. GOVERNING LAW & JURISDICTION

This Privacy Policy shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any dispute arising out of or relating to this Privacy Policy shall be subject to the exclusive jurisdiction of the competent courts in Pakistan.


14. ELECTRONIC RECORDS & EVIDENTIARY VALUE

Electronic records, system logs, IP addresses, timestamps, communication records (including WhatsApp messages), and related technical data maintained by the Company shall be admissible as evidence to the maximum extent permitted by applicable law.


15. DATA SECURITY

The Company employs commercially reasonable administrative and technical safeguards.
However, no system is entirely secure, and the Company does not warrant absolute security.


16. USER RIGHTS

Requests for access, correction, or deletion of data may be considered at the Company’s discretion.
Requests may be denied where retention is required by law, contract, or legitimate business interests.


17. INTERNATIONAL DATA PROCESSING

Information may be processed or stored on servers located inside or outside Pakistan.
Use of the Service constitutes consent to such processing.


18. CHILDREN

The Service is not intended for individuals under eighteen (18) years of age.


19. AMENDMENTS

The Company reserves the right to amend this Policy at any time.
Continued use of the Service constitutes acceptance of the amended Policy.
